Terms of use
The contracting party is Rosarium c/o Maurizio Tini, Strada Trasimeno Ovest 116, 06127 Perugia, Italy.

By placing an order from the online store at www.rosarium.it, the Customer declares that they have read all the information provided to them during the purchase process and accept in full the General Terms and Conditions along with the payment terms transcribed below. 

Product Information
All products on the site come with a detailed product description which includes illustrative photographs. Before ordering, please read the product information carefully and contact Customer Service at +39 075 5058334 if you’d like more information. All products on the site are available except those stating otherwise. 

Purchase process
Products are offered for sale according to the Terms and Conditions outlined in the contract and published on the site at the time of the order. To purchase, the Customer must proceed through the instructions on the site to place items in their shopping cart and confirm their intent to purchase the selected merchandise.

The contract is considered concluded and binding on the parties when Rosarium (Maurizio Tini) sends the order confirmation to the Customer's email address, as indicated by the Customer when they registered on the site or upon order confirmation. This confirmation message will include the Date and Order Number, which is to be used in any further communication with www.rosarium.it relative to that order.

It is the Customer's responsibility to register using the correct information and to keep this information up to date via their login credentials.

In case of unexpected unavailability of the merchandise and non-acceptance of the order, the Customer will not be charged. Cancellations made after delivery to the courier must instead be made by the Customer exercising their Right of Withdrawal within 14 (fourteen) days of delivery and paying the cost of returning the product to Rosarium (Maurizio Tini). 

Prices are quoted on the website in Euros (€), which is the currency of reference and includes current VAT rates.
Prices of individual items do not include shipping costs.

These will be specified during the purchase process. Determination of price and method of payment The total price at the conclusion of the order process includes shipping costs, if applicable. Merchandise shall be paid for in the following manner: 

In Italy all purchased products are delivered in 24/48 hours (up to 72 for islands), processing time excluded. Insured shipping by express courier is € 10.00 and is free for purchases with amounts over € 89.00. For inconvenient areas, on the other hand, the shipping cost is fixed and is € 15.00.
For shipments to Europe and the Rest of the World, purchased products are delivered in 4/5 working days, processing time excluded. Shipments are made via the express couriers DHL or FEDEX and have a cost that varies depending on the destination. 

For PayPal purchases, PayPal will immediately charge the purchase amount upon conclusion of the online transaction. At no time during the purchase process will www.rosarium.it have access to the purchaser's credit card information or other information provided to PayPal. 

Bank Transfer
Bank transfer purchases must be paid in advance and made within 48 hours after order placement to the following bank account number:
Actual crediting of the payment must be completed for the order to be processed.

Delivery methods and timeframes
For every order placed on www.rosarium.it, Rosarium (Maurizio Tini) will issue a receipt or invoice for the shipped item(s) and post it to the customer's dashboard. By issuing the invoice, the information provided by the Customer at the time of the order shall be used as the basis for the invoice.
After issuing the invoice, no changes are possible. It is the responsibility of the Customer, prior to placing the Order, to verify their ability to receive the Product. From the time the order is received by the courier, deliveries are made within approximately 24-48 hours nationwide and up to 72 hours for islands and remote geographic areas, except in cases of force majeure.

Rosarium (Maurizio Tini) assumes no responsibility in the event of a delivery delay on the part of the courier.
Upon delivery of the merchandise by the courier, the Customer is required to verify that that the number of packages being delivered corresponds to the number indicated on the shipping document and that the packaging is intact, undamaged, hasn’t gotten wet or has been otherwise altered, including in the sealing materials (adhesive tape and/or heat-sealed strapping).

Any damage to the packaging and/or product or discrepancy in the number of packages or order specifications must be challenged immediately by placing a written SUBJECT TO INSPECTION on the courier’s proof of delivery.

Once the courier’s document is signed without reservation, the Customer may not object in any way to the outward characteristics of what has been delivered. Any problems with the physical condition, accuracy or completeness of the product(s) received must be reported within 14 (fourteen) working days after delivery in the manner provided herein. If the merchandise is not collected from the courier within 15 (fifteen) working days due to the repeated inability to deliver to the address indicated by the Customer upon order placement, the order will be automatically canceled. In the event that the merchandise is not collected during the storage period, the Customer shall pay for any costs pertaining to that storage. I

n the event that the merchandise is not returned in an undamaged state or the return was not authorized by Customer Service, a refund will not be issued, and the cost of returning the merchandise to the Customer shall be paid by the Customer and in advance.
A refund for the merchandise’s purchase price will be made within 14 days after receipt of the returned merchandise and after verifying the condition of the returned product(s). The refund does not include shipping costs incurred in sending the goods or returning the goods. The Company shall issue the refund via the same payment method used by the customer.

The Company does not reimburse shipping costs for returns.


Force Majeure
The parties shall not be liable for delays in the fulfillment of their obligations under the contract if such delays are caused by circumstances beyond their reasonable control. The delayed party, due to force majeure, shall be entitled to an extension of time necessary to fulfill their obligations. 

Right of Withdrawal
Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014 (Consumer Code), the Customer may withdraw from the purchase contract for any reason, and without stating their reason, within 14 (fourteen) days of receiving the goods.

Reimbursement does not include shipping costs for subsequent returns.
The Customer may exercise their Right of Withdrawal by contacting Customer Service at +39 075 5058334 Tuesday through Saturday from 9:00 am to 1:00 pm and from 3:30 pm to 7:30 pm.

You must provide the Order number to facilitate the return process.
According to the second paragraph of Article 55 of the Consumer Code, the Customer shall not have the Right of Withdrawal in the following cases: For the provision of custom-made or personalized products or products that, by their very nature, cannot be returned or are likely to deteriorate or alter rapidly.

Moreover, the Right of Withdrawal cannot be exercised by the Customer if the product is not intact, i.e.: If it's missing its original packaging In the absence of integral product elements (labels, etc.) For damage to the product caused by the Customer 


Products return
For product returns, the Customer has 14 (fourteen) days from delivery of the product to contact Customer Service to initiate the return process.
Returns should be sent to Rosarium c/o Maurizio Tini, Strada Trasimeno Ovest 116, 06127 Perugia, Italy 14 (fourteen) days after withdrawal.

Products must be returned undamaged and in their original packaging (not used, damaged or soiled by the customer). Costs and risks associated with returning products are the responsibility of the sender.
Refunds will be made within 14 (fourteen) days from the receipt of the notice of withdrawal through a reversal of the amount charged, using the same payment method that was used by the Customer for the initial transaction, unless otherwise agreed.

The Customer will not incur reimbursement fees. Rosarium (Maurizio Tini) will withhold the refund until receipt of the returned product(s) or until the Customer demonstrates that they have properly returned them.
Refunds for cash-on-delivery payments must be arranged through Customer Service. To request a refund via a Bank Transfer, you’ll need to provide the first and last name of the account holder (which may be different from the name of the person who placed the order), IBAN code and bank name.

Reimbursement includes the purchase price of the product(s) ordered with the exception of the shipping costs, which remain the responsibility of the Customer. In the event of a return due to a defect (non-conforming goods), shipping costs will also be refunded. 


Data sent by the customer for execution of the contract is processed in accordance with the provisions of Legislative Decree No. 196 of 2003 "Protection of Personal Data". See the "Privacy" section for more information. 


Users may receive newsletters with updates on products, services and promotions. 


Applicable Law and Jurisdiction
The sales contract between the Customer and Rosarium (Maurizio Tini) is understood to be concluded in Italy and governed by Italian Law. For resolution of civil and criminal disputes arising from the conclusion of this online sales contract, if the Customer is a consumer, territorial jurisdiction is that of the court of reference of their municipality of residence.
In all other cases, the territorial jurisdiction is exclusively that of the Court of Perugia.
